I'm expecting a REFUND, but I have NOT filed my tax return and the deadline has passed. Is it too late to file? Will I be charged a late filing penalty? |

Is it Too Late to File? It's NEVER too late to file a tax return. You should file as soon as possible because the statute of limitations does not begin until you file. If you are expecting a refund and it has been LESS THAN 3 years from the due date of the return or 2 years from the date you paid the tax, whichever is LATER, you will receive your refund. However, if you are not within the time frame described above, you will NOT receive a refund. You should still file the return, because the IRS does not know you have a refund shown on the return until it is filed! Will I be Charged a Penalty for Filing Late? If there is a REFUND shown on the tax return, there are NO penalties imposed for filing a personal income tax return late. However, it is still a violation of law to file late. A late filing penalty is based upon unpaid taxes as of the due date of the return. This does NOT apply when a refund is shown. |
